These Terms of Use apply to the Travel Guide NYC iOS app and related informational website published by Equilibriumpress. By using the app, you agree to use it responsibly and subject to these terms and applicable law.
2. Purpose of the app
Travel Guide NYC provides editorial travel information, curated places, themed guides, maps and walking routes for discovering New York City. It is a planning and discovery product, not an emergency, safety-critical, accessibility-assurance or professional navigation service.
3. Maps, distance and walking routes
Map locations, distance calculations, route lines and stops may contain inaccuracies or become outdated. Conditions can change because of construction, weather, traffic, closures, crowd control, private-property restrictions or other circumstances.
You are responsible for selecting a safe and lawful route, observing signs and local instructions, respecting access restrictions and adapting to actual conditions around you.
4. Accuracy and availability
Equilibriumpress aims to provide useful and current information but does not guarantee that every place, opening hour, price, transit detail, guide, route or external link is complete, current, continuously available or suitable for a particular trip. Important information should be checked directly with venues, transport operators or official authorities.
5. Offline and refreshed content
The app can include bundled editorial content for offline-first use and may retrieve refreshed information when a network connection is available. Offline content may therefore differ from newer information available online or from current real-world conditions.
6. Third-party services and content
The app may use, embed or link to services and content provided by Apple, Notion, YouTube, image hosts, official websites, Wikipedia, Wikivoyage and other third parties. Those services are governed by their own terms, licences and privacy policies. Equilibriumpress does not control or guarantee third-party services, availability or content.
7. In-App Purchases and NYC Full Guide
Travel Guide NYC may offer an optional one-time In-App Purchase called NYC Full Guide. This purchase unlocks the additional guides, walks and related content identified in the app as part of the Full Guide. It is not an automatically renewing subscription.
In-App Purchases are offered and processed through Apple's App Store and StoreKit. Payment authorization, billing, purchase history and any applicable App Store purchase rules are handled by Apple and are also subject to the terms associated with your Apple Account and the App Store.
Access to purchased content is granted after StoreKit reports a verified entitlement for the corresponding product. The app provides a Restore Purchases function so an eligible purchase associated with the Apple Account can be checked again. A refunded, revoked or otherwise invalidated entitlement may no longer provide access when StoreKit reports that change.
Requests concerning payment processing, App Store billing or refunds are handled under Apple's applicable policies and processes. Nothing in these terms limits any statutory consumer rights that apply to you.
The selection and amount of editorial content in the app may evolve over time. Content described in the app as included with NYC Full Guide will remain subject to these Terms of Use, content availability, third-party rights and normal editorial updates.
8. Editorial and media rights
The app's original selection, presentation, written editorial material, layout and design are protected by applicable intellectual-property laws. Photographs, maps, videos, trademarks and other third-party materials remain the property of their respective rights holders and may be displayed under permission, attribution, licence or another lawful basis.
9. Acceptable use
You may use Travel Guide NYC for personal travel planning and exploration. You may not intentionally interfere with the app or related services, attempt unauthorized access, circumvent technical or purchase restrictions, misuse third-party services, or systematically extract and republish substantial portions of the editorial database where prohibited by law.
10. No warranties
The app and website are provided on an “as available” basis. To the extent permitted by applicable law, Equilibriumpress disclaims warranties regarding uninterrupted availability, completeness, accuracy, fitness for a particular purpose and non-infringement, except where those warranties cannot legally be excluded.
11. Limitation of liability
To the extent permitted by applicable law, Equilibriumpress is not liable for indirect, incidental or consequential loss arising from reliance on travel information, route choices, third-party services, changing real-world conditions or temporary unavailability of the app or website. Nothing in these terms excludes liability that cannot legally be excluded.
12. Changes to the app, content or terms
The app, content sources, features and these terms may change over time. Updated terms apply from the effective date shown on this page. If you do not agree with updated terms, discontinue use of the app. Changes to these terms do not remove consumer rights or purchase rights that cannot legally be waived.
